Terms of Service

These Terms of Service ("Terms") govern your use of the Nakama mobile application and website (collectively, the "Service"), operated by Nakama ("we", "us", or "our"). By downloading, installing, or using Nakama, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years of age (or 18 years of age for the NSFW build), that you have read and understood these Terms, and that you agree to be legally bound by them. If you are under 18 and using the SFW build with parental permission, a parent or guardian must agree to these Terms on your behalf.

2. User Accounts

You are responsible for maintaining the security of your account credentials. You must notify us immediately at nakamaai92@gmail.com if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized account use.

You may not create accounts for others, use automated tools to create accounts, or impersonate other users or real persons.

3. User Conduct

You agree not to use the Service to create, publish, or share content that:

• Depicts or sexualizes minors in any way (zero tolerance — immediate permanent ban and law enforcement referral)
• Constitutes harassment, threats, or targeted abuse of any individual
• Is illegal in your jurisdiction or the jurisdiction of our servers
• Infringes the intellectual property rights of others
• Contains malware, spam, or attempts to compromise other users' devices or accounts
• Impersonates real, living public figures in a deceptive or harmful manner
• Promotes or glorifies real-world violence, terrorism, or self-harm

4. Content Ownership

You retain full ownership of the characters, stories, and other content you create using Nakama. By publishing a character to the Discover feed, you grant Nakama a non-exclusive, royalty-free, worldwide license to display that content within the Service for the purpose of enabling other users to discover and interact with it. This license terminates when you unpublish or delete the character.

We do not claim ownership of your unpublished characters or chat history, which remain stored locally on your device.

5. AI-Generated Content

Nakama uses third-party AI language models to generate chat responses. AI responses are generated automatically and do not represent the views or opinions of Nakama. We do not review AI responses before they are displayed. You acknowledge that AI responses may occasionally be inaccurate, inappropriate, or unexpected, and you use the Service at your own discretion.

You are solely responsible for the character definitions and prompts you create. Creating character definitions designed to circumvent content policies violates these Terms.

6. NSFW Content

The NSFW version of Nakama is restricted to users who are 18 years of age or older. By downloading or using the NSFW build, you confirm that:

• You are at least 18 years old
• Access to adult content is legal in your jurisdiction
• You will not share the NSFW build or its content with minors
• You understand that NSFW content is not available through the Google Play Store

All NSFW content must depict fictional adult characters only. Content that appears to depict minors — regardless of any stated fictional age — is absolutely prohibited.

7. Subscription Terms

Auto-Renewal: Nakama+ and Nakama Pro subscriptions are billed on a recurring monthly basis through Google Play. Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date.

Cancellation: You can cancel your subscription at any time through the Google Play subscriptions page. Cancellation takes effect at the end of the current billing period — you retain access to premium features until then. We do not provide partial refunds for unused periods.

Price Changes: We may change subscription prices with at least 30 days' notice. Continued use of the subscription after a price change constitutes acceptance of the new price.

Refunds: Refund requests are handled by Google Play in accordance with their refund policy. We do not process refunds directly.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice. Violations involving illegal content (particularly CSAM) will result in immediate permanent termination and referral to law enforcement. You may delete your account at any time by contacting nakamaai92@gmail.com.

9. User-to-User Interactions, Direct Messages & Live Rooms

The Service may allow you to communicate and roleplay directly with other users through direct messages, group rooms, and live multiplayer features (collectively, "User Interactions"). User Interactions are available only in the 18+ NSFW build and only to age-verified adult users.

• You interact at your own risk. Other users are independent third parties. We do not and cannot pre-screen, monitor, or control the real-time messages exchanged directly between users. We are not responsible for the content, conduct, accuracy, safety, or behavior of any other user.
• Assumption of risk. You understand that interacting with other people — who may be strangers — carries inherent risks, and you voluntarily assume all such risks. You should never share personal, financial, contact, or identifying information with other users, and you should not arrange offline contact.
• Consenting adults only. By participating in any User Interaction you confirm you are at least 18 years old and that you will engage only in roleplay involving fictional adult characters between consenting adults. Any content or conduct that sexualizes minors, harasses, threatens, defrauds, or harms another user is strictly prohibited and will result in immediate termination and, where applicable, referral to law enforcement.
• Moderation tools, not a guarantee. We provide blocking and reporting tools and may remove users from rooms, suspend, or terminate accounts at our discretion. However, we are under no obligation to monitor User Interactions, and we do not guarantee that any objectionable conduct will be prevented or addressed.
• No liability for user conduct. To the maximum extent permitted by law, we are not liable for any loss, harm, distress, or damages of any kind arising from your interactions with other users, including content they send you, their conduct, or any contact that occurs on or off the Service.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nakama, its developer, operators, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) the content you create, publish, send, or transmit; (b) your interactions with other users; (c) your use or misuse of the Service; (d) your violation of these Terms; or (e) your violation of any rights of any third party. This obligation survives the termination of your account and these Terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

AI-generated responses are not guaranteed to be accurate, appropriate, or safe. Use your own judgment when relying on AI-generated content.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NAKAMA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE MONTHS PRECEDING THE CLAIM.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for violations involving intellectual property or illegal content.

14. Changes to These Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via in-app notification or email. Continued use of the Service after the effective date of the updated Terms constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the Service.

15. Intellectual Property / DMCA

Nakama Ai complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We respond to valid copyright infringement notices promptly. Repeat infringers will have their accounts terminated in appropriate circumstances.
